General

These Terms Of use are a legally binding Agreement (the Agreement) between Dateabilityuk.com and You for the service we provide.

We reserve the right to amend this Agreement from time to time and the amended Agreement shall be published on our Web Site. If the Agreement is amended then the amended version shall supersede all earlier versions and the version currently published on our web site shall form the sole and exclusive Agreement between us.

If you do not agree with this Agreement (as amended from time to time) then you cannot use this web site.

This Agreement shall come into effect when, having completed a profile to become a member of our web site on the joining page, you press the "Join Now" button that appears on the page.

The Service

The service we provide includes but is not limited to that of allowing you to publish a profile on our web site describing yourself, browse the profiles of other members of our site, and send messages to and receive messages from other members of our web site.

The cost of the service we provide and the period for which it is provided are explained on our web page called "Pricing" as amended from time to time. The payment methods we accept are only those outlined on the aforementioned web page. Many parts of the service we supply are free.

We shall use all reasonable efforts not to disclose to any third party your real name, email address or any information that may enable you to be identified except as we may be required by law.

We reserve the right to:-

amend the service we provide from time to time;
suspend the service from time to time for business or for technical reasons;
terminate the service at any time;
refuse new members or subsequently cancel membership of existing members whether or not payment has been made for our service;
suspend or terminate your access to the service without notice.

Your Certification

You Certify that:

you are 18 years of age or over;
you are a full time resident of UK or Republic of Ireland;
you are genuinely seeking friendship and/or a relationship;
you accept that other people using our web site will be able to view your profile and send you messages via our website.
you accept that we may place a link directly to your profile from the home page of our web site (unless you request otherwise by emailing us and we confirm back to you by email);
you accept that if you disclose personal information in your profile or in messages sent to other members/people using our web site then you do so entirely at your own risk;
you will not use our web site for commercial purposes;
you will not use our website to recruit our members to form another community, online or otherwise, whether for profit or not;
you will not use our web site to send junk mail;
you will not use our web site in a manner which may cause offence to another person using our web site;
the information you include in your profile is a true representation or likeness of you;
you own the copyright to text or photographs you include in your profile and assign that copyright to us;
you give your permission for any photographs taken of you at meetings arranged through our message boards or otherwise to be published on our website;
you will not include photographs of children in your profile;
you will not include any information in your profile that would facilitate direct contact with other members, including but not limited to your last name, your address, your email address, your telephone number or a web address;
you will not under any circumstances include in your profile any photographs containing nudity, obscene, lewd, violent, harassing, sexually explicit or otherwise objectionable subject matter;
you will not include your membership status of our web site in your profile;
you will not include in any message you send to another member/user of our web site any information which is contrary to any law or which invades the privacy of any other party;
you accept that we may at our sole discretion and without notifying you edit or delete your profile or open, edit or delete any messages you send or receive if we see fit to do so for whatever reason;
you accept that we may delete or remove any of your member content that we believe, in our sole discretion, violated this Agreement or is in anyway offensive, illegal, misleading, or violates the rights of, harms, or threatens the safety of any person;
you will not allow another person to use our website by virtue of making available to them your username and password;
you will not copy and you will keep confidential any information published on our web site including but not limited to the information contained in profiles of other people using our web site;
you will not publish duplicate profiles on our web site;
you will not use your credit card to pay for another user of our web site to upgrade their membership nor allow another person to use their credit card to pay for you to upgrade your membership;
if you arrange to meet anyone through our web site then you do so entirely at your own risk;
We may record your IP address and the link URL (if any) via which you found our web site.

Advertisements and Third Party Links

We allow advertisements on our Site, but try to make sure they are clearly marked as Advertisements. Advertisements found on our web site do not express the views or opinions of Dateabilityuk.com. Our web site may provide links to third-party web sites. Dateabilityuk.com does not recommend, monitor, control or endorse any third party advertising or content, nor the content on any third-party web sites and is not responsible for their terms of use or privacy policies or how they may treat your information. Your use of third-party web sites is at your own risk. Dealings you have with advertisers found on our web site are between you and the advertiser, and you acknowledge and agree that we are not liable for any loss or claim you may have against an advertiser.

Guarantee, Indemnity and Liability

We do not guarantee the accuracy of any information contained in our web site that is supplied by other members/users of our web site nor do we guarantee any results from our service.

You will indemnify us, our officers and employees from any claim made arising from your breach of this Agreement or from your conduct whilst using our web site.

We shall not be liable to you for any damages or any kind arising out of the use of our service including but not limited to the misuse of your personal information by other users of our web site, except insofar as by law we are not permitted to exclude liability. Your statutory rights remain unaffected.

Termination

Either party may terminate this Agreement at any time for any reason. If you wish to terminate this Agreement you can do so by emailing us via the web page "Contact Us". Refunds will only be given at our discretion.

Due to our Policy and Service being in three month period sections termination can be done within this period and your profile removed but no refunds will be given unless more than one 3 month section has been purchased in advance the refund you will receive will be for the remaining three month section or sections PROVIDED that the date of request of termination does not fall within the remaining three month section or sections.

Jurisdiction

This Agreement is governed by English Law and should any part of them be found to be unenforceable then the remainder shall still apply..
